Termination of parental rights - when and why it is possible
Termination of parental rights is not a “punishment”, but a serious legal decision that is made only when one of the parents systematically harms the interests of the child or is unable to fulfill their duties. The reasons may be different: alcohol or drug abuse, domestic violence, complete indifference to the child, or even a long stay in prison. Parental rights can be terminated not only at the initiative of the other parent - the case can be initiated by a school, a guardianship institution, or even neighbors. The main thing is to protect the child.
How to apply for termination of parental rights
The process begins with the preparation of an application to the family court at the child's place of residence. The court fee is PLN 100. The application must be accompanied by:
- the child's birth certificate,
- a court decision on divorce or alimony (if any),
- evidence: correspondence, witness statements, certificates, screenshots, photos.
In more complicated cases, it is worth filing a petition for temporary suspension of rights for the duration of the case - this can protect the child at an early stage.
Stages of the trial for termination of parental rights
- Initiation of proceedings: at the request or on the initiative of the court/guardianship authorities.
- Court hearings: both parties are heard, witnesses may be called, and a psychological examination (OZSS) is ordered.
- Evaluation of the child's situation: the court takes into account everything from emotional bonding to living conditions.
- Court decision: in case of deprivation, the parent loses the right to decide on any issues regarding the child (education, place of residence, treatment).
The average time for consideration is several months, but much depends on the evidence and participation of the parties.
