Case — Divorce and Alimony Without Husband's Consent
In January 2023, I was contacted by a client – a Ukrainian woman with a child, residing in Poland as a refugee. She wanted to divorce her husband, who remained in Ukraine, but he categorically refused to consent to the divorce and did not provide financial support for the child. Additionally, there was a problem – the client did not have the marriage certificate.
Situation Description
The client approached me with the desire to divorce her husband, who was in Ukraine. The main problem was the lack of a marriage certificate, as the documents were not preserved after emigrating to Poland. Since the husband did not consent to the divorce and did not provide financial support for the child, a number of legal actions had to be taken to resolve the situation.
Steps Taken to Resolve the Problem
- Obtaining a Duplicate of the Marriage Certificate: We contacted the registration authorities in Ukraine to obtain a duplicate of the marriage certificate, which was the first step in the divorce filing process.
- Preparing the Divorce Lawsuit: After receiving the documentation, we prepared the divorce petition and filed it with the court.
- Preparing the Alimony Lawsuit: Simultaneously with the divorce lawsuit, a claim for alimony for the child was prepared.
Filing the Lawsuits
The client personally filed the lawsuits in court in Ukraine. This allowed initiating the legal divorce process and addressing the issue of alimony despite the husband's refusal to consent.
Main Difficulties Faced by the Client
- Absence of the Marriage Certificate: The main difficulty was the absence of the marriage certificate required to file the lawsuit. This was resolved by obtaining a duplicate from the registration authorities in Ukraine.
- Husband's Refusal to Consent: The husband categorically refused to consent to the divorce, which complicated the process, but we successfully navigated through all the necessary stages.
- Problems with Funding Court Expenses: The client faced difficulties covering court costs, but we found a solution by assisting in obtaining financial support for such situations.
Outcome of the Case
As a result of the legal actions taken, the client received a positive court decision:
- On May 1, 2023, the court issued a divorce decision (Case No. 607/4846/23).
- On May 17, 2023, the court awarded alimony (Case No. 607/4848/23).
Both decisions became final, and the client successfully completed the divorce and alimony process.
