Residence permit based on marriage to a Polish citizen
Marriage to a Polish citizen enables obtaining a Residence Card (residence permit) on legitimate grounds.
It should be noted that a Residence Permit based on family reunification and marriage are different matters and are treated differently.
Marriage can be contracted both within the territory of the Republic of Poland and in another country, as long as the Polish side recognizes this marriage as legal. Marriage in Poland can be conducted at the Civil Registry Office (civil marriage) or in a church.

Documents required for applying for a Residence Card based on marriage:
- Application form - 2 copies;
- Photo 3.5x4.5 cm, taken no later than 6 months before submitting the application - 4 copies;
- Original and copies of the passport - 2 copies;
- Receipt for payment of state duty for document processing;
- Copy of the marriage certificate, concluded no earlier than 3 months before submitting the application for the Residence Card;
- Original passport and copies of husband/wife;
- Documents confirming joint residence of the spouses and joint household management.
A residence permit based on marriage is issued for a term of 3 years. This is considered a temporary residence permit, which requires reapplication after the expiration of the term.
To obtain a permanent Residence Card valid for 10 years, you need:
- The marriage must have been contracted with a Polish citizen at least 3 years ago;
- Residing in the country for at least 2 years continuously;
- The marriage must be recognized by Polish law.
All documents issued by another state must be translated into Polish by a sworn translator and have an apostille.
According to Article 169 of the Foreigners Law, state authorities may verify the authenticity of the marriage.
