Drafting of notarial documents, including: statements of inheritance acceptance or renunciation (can be prepared in one or two languages), as well as registration with a Polish notary. Preparation of notarial deeds for the sale or purchase of real estate in Ukraine.
Client's Request:
A client contacted me who, at the time, was living outside Ukraine. His request concerned assistance with re-registering inheritance after his mother's death. Due to living abroad, the client was unable to personally travel to Ukraine to handle document processing and legal matters related to the inheritance. He needed a maximally effective solution that would allow all issues to be resolved remotely.
Main Challenges We Faced:
Finding the Inheritance Case
The client's mother passed away back in 2018. Although the client submitted an inheritance acceptance application on time — within the established six-month period — the notary originally handling the case, for personal reasons, transferred it to another notary. This caused some confusion, as the client did not know which notary currently held the case. The first task was to determine which notary was now in charge.
Destroyed Property
The property left after the mother was located in a previously occupied, now de-occupied territory of Ukraine. After military actions, the property was completely destroyed. The challenge was not only to formalize the inheritance but also to prepare a document package for submitting a claim for compensation for the destroyed property.
Stages of Working on the Case:
✅ Conducting the Initial Consultation.
At the first stage, I conducted a consultation during which we discussed the details of the case, identified all “bottlenecks,” and clarified the client's expectations. We drew up a list of key issues: to find out who was handling the inheritance case, prepare documents to obtain the certificate of inheritance rights, and clarify the procedure for submitting documents for compensation for destroyed property.
✅ Identifying the Notary in Charge.
I contacted the relevant notarial authorities in Ukraine to find out which notary currently had the inheritance case. This allowed us to move forward — without this information, it was impossible to obtain the inheritance certificate.
✅ Preparation of the Power of Attorney.
Given that the client was abroad, it was necessary to prepare a power of attorney for a representative in Ukraine.
I drafted the text of the power of attorney in accordance with Ukrainian law, including:
- the right to accept the inheritance;
- the right to obtain the certificate of inheritance rights;
- the right to submit documents for compensation for destroyed property.
✅ Adapting Documents for Poland.
Since the client was in Poland, we arranged for the translation of the power of attorney from Ukrainian to Polish. We also prepared the document in a format that met the requirements of Polish law. We involved a Polish notary to draft the notarial deed in the form of a power of attorney, which is recognized in both Ukraine and Poland.
✅ Coordination Between Parties.
I coordinated the work between the client, the Ukrainian notary, and the Polish notary to ensure the proper preparation and timely execution of all documents. Thanks to clear communication, we avoided delays and misunderstandings.
Result:
The client received a complete set of documents that complies with both Ukrainian and Polish legislation. Most importantly, he did not have to leave his country of residence, and all issues were resolved remotely, quickly, and professionally. The client received:
- a prepared power of attorney for the representative in Ukraine;
- the certificate of inheritance rights;
- the ability to submit a claim for compensation for the destroyed property.
The client was completely satisfied with the service, describing it as prompt, well-coordinated, and comfortable. All actions were carried out within the established timeframe, which is especially important for people living abroad.
The successful completion of this case was made possible thanks to the lawyer's high level of professionalism, a comprehensive approach to problem-solving, and the ability to work with international documents. Knowledge of Ukrainian and Polish legislation, attention to detail, clear coordination between all parties, and the ability to anticipate potential difficulties ensured a positive result and maximum protection of the client's interests.
