Drafting of notarial documents, including: statements of inheritance acceptance or renunciation (can be prepared in one or two languages), as well as registration with a Polish notary. Preparation of notarial deeds for the sale or purchase of real estate in Ukraine.
Client Request: A client reached out to me who was residing outside Ukraine at the time of contact. The client’s request concerned assistance with re-registering an inheritance after the death of his grandmother. Additionally, the client needed to obtain documents for an apartment in a newly built residential complex that was registered in his name, as well as to receive the keys to this apartment. Since the client was abroad and unable to travel in person, he was seeking a solution that would allow all issues to be resolved remotely in both Ukraine and Poland.
Main Challenges We Faced
- Inheritance registration under a will
The inheritance was to be registered under a will. It was necessary to prepare documents for accepting the inheritance and obtaining a certificate of inheritance rights. - Obtaining documents for the new apartment and keys
It was necessary to authorize a representative in Ukraine who could collect the apartment documents and keys. - Preparation of documents valid in two jurisdictions
It was crucial to prepare a power of attorney that would be recognized both in Ukraine and Poland, where the client was residing, and that would comply with the legal requirements of both systems.
Work Stages
✅ Initial consultation
At the first stage, we discussed all the case details, identified problem points, and clarified the client’s needs. We drew up a list of main tasks: to prepare a power of attorney for accepting the inheritance, obtaining the apartment documents and keys, and ensuring the documents complied with the laws of Ukraine and Poland.
✅ Drafting the power of attorney
I prepared the text of the power of attorney in accordance with Ukrainian law, including the following authorities:
- the right to accept the inheritance under the will;
- the right to obtain the certificate of inheritance rights;
- the right to obtain documents and keys to the apartment.
✅ Adapting the documents for Poland
Since the client was in Poland, we engaged a Polish notary to prepare the document in the format of a notarial deed in the form of a power of attorney (Akt notarialny w formie pełnomocnictwa). We ensured proper translation, checked compliance with both legal systems, and arranged correct notarial execution in Poland.
✅ Coordination between parties
I coordinated the work between the client, the Polish notary, and the Ukrainian notary to avoid delays. Thanks to clear communication, we quickly agreed on the document texts and ensured timely signing and dispatch of the power of attorney to Ukraine.
Result
The client received:
- a prepared power of attorney recognized in both Ukraine and Poland;
- the ability to register the inheritance under the will without personal presence;
- documents for the apartment in the new building;
- the keys to the apartment.
The most important point — all issues were resolved remotely, and the client did not have to spend time or money traveling to Ukraine.
