Marriage Registration in Poland – A Case with Solutions to Complications
In February 2023, a couple of Ukrainian citizens approached me, wishing to register their marriage in Poland. However, several difficulties arose:
- Previous Marriages: Both had previous marriages but did not have divorce decrees in hand.
- Unable to Travel to Ukraine: Given the situation in Ukraine, they could not travel to obtain the necessary documents.
- Polish Court Requirement: A decision from the Polish court was necessary to register the marriage in Poland.
The Situation
At first, everything seemed straightforward, but during the process, it became clear that the situation was much more complicated. Here is what became necessary to resolve the case:
- Obtaining Documents: It was necessary to obtain the divorce decrees from their previous spouses to confirm the legal validity of the marriage.
- Document Translation: All documents needed to be translated into Polish and notarized.
- Preparing the Court Application: To obtain a decision from the Polish court regarding the possibility of marriage, it was necessary to prepare an application and additional materials.
The Solution
I helped:
- Obtain a Duplicate of the Divorce Decree: We contacted the relevant authorities in Ukraine and obtained the necessary documents.
- Notarized Translation: All documents were translated by a notary with confirmation of authenticity.
- Prepare the Court Application: I prepared the application to the Polish court for approval to register the marriage.
- Obtain the Court Decision: As a result of the court application, a decision was obtained confirming the possibility of marriage.
- Register at the Urząd Stanu Cywilnego: I helped submit the documents to the Polish civil registry office.
- Official Marriage Registration: On March 8, 2024, the marriage was officially registered, and I was present as a translator.
Why Was This Complicated?
The marriage registration process became difficult for several reasons:
- Court Application Requirement: The need for a Polish court decision required us to go through a legal process, which took extra time.
- Translation and Notarized Documents: The translation and notarization of the documents required time and additional expenses.
